  4. The Course Content may include links to third-party websites. The owner of such a third-party website is solely responsible and liable for its content. That content is not under the Instructor's control. At the time of linking to a third-party website, the third-party content was deemed to be in no violation of the law. The Instructor shall promptly remove a third-party link upon becoming aware of it being in violation of the law.

  5. The Instructor shall not be liable for any damages caused by your use of this Website or of the Course Content, unless damages occurred due to intentional and gross negligent breach of duty by the Instructor, or due to breach by the Instructor of any of the Instructor's cardinal contractual duties. Cardinal contractual duties are obligations whose fulfillment is indispensable for the proper implementation of an agreement and on whose fulfillment the contracting parties can usually rely. In the event of a breach of any of the Instructor's cardinal contractual duties due to ordinary negligence by the Instructor, a) the liability shall be limited to typical foreseeable contractual damages if damages relate to a fee-based service or product, and b) no liability applies if damages relate to a free service or product. Any other liability by the Instructor as it relates to your use of this Website or of the Course Content is excluded, except for damages resulting from injury to life, body, or health due to a breach of duty. Liability pursuant to the German Product Liability Act shall remain unaffected.
